Please read the following terms carefully.


By participating in any class provided by Flow & Co. Pilates (ABN 62 102 277 863), you consent to and agree to release Flow & Co. Pilates and its Instructors from liability in accordance with these terms. Unless Flow & Co. Pilates notifies you otherwise, this waiver and release will apply to all classes undertaken by you with Flow & Co. Pilates.

WAIVER & RELEASE OF LIABILITY

You acknowledge and agree that:

You are over 16 years of age;

You understand that the classes are a form of physical activity and that there are inherent risks in undertaking any form of physical exercise;

You have disclosed, or will disclose to the Instructor prior to the class commencing, any pre-existing conditions that may place you at a higher risk of injury or inhibit your ability to participate in a class, including but not limited to:
  • Injuries, pain or recent surgery;
  • Pregnancy or if you have recently given birth; or
  • Respiratory or heart conditions or high blood pressure.

You will notify the Instructor if you experience any pain throughout the class and will immediately stop participating in the class if requested by the Instructor to do so;

Based on the information you provide, the Instructor may decide not to allow you to participate in a class, or may require you to provide a medical certificate confirming that you are able to participate in a class before allowing you to join, in the Instructor’s sole discretion;

Recommendations or instruction provided by the Instructor may not be tailored for your particular skill or ability level and it is your responsibility to assess whether you are able or want to participate in all or part of a class;

You are solely responsible for ensuring that your physical environment is suitable for your participation in any class; and

Classes may be recorded by Flow & Co. Pilates for quality control and promotional purposes. If you do not consent to Flow & Co. Pilates using video or still images taken during the class for promotional purposes, please notify Flow & Co. Pilates in writing.

To the extent permitted by law, you release and hold harmless Flow & Co. Pilates (and where applicable its directors, employees, contractors and representatives) from any liability, cost, expense, damages or claims (including claims of negligence) arising from or which may be suffered or incurred in connection with your participation in any classes provided by Flow & Co. Pilates.

You acknowledge that Hot Mat classes are conducted in high temperatures ranging from 34 to 36 degrees Celsius, and you accept the risks associated with exercising in such conditions.
I understand that by signing this form I am waiving valuable legal rights.
CLASS CANCELLATIONS

Cancellations of classes must be made 24 hours prior to the class start time. If not, the Full Class Rate will be charged. No exceptions. This allows for other members on the waitlist to attend the class.

All cancellations must be submitted only via our ‘Flow & Co. Pilates’ App. We will not accept text messages, emails or phone calls.

No Show Policy: Any missed booking without prior notice will result in a charge of $10.

Flow & Co. Pilates reserves the right to cancel classes should there be less than 3 people booked into the class. We will notify you up to 1 hour prior to the scheduled class start time. Flow & Co. Pilates will refund the class and reschedule you into another time of your selection.

Flow & Co. Pilates reserves the right to change the instructor of the class without notice, in the event that the Instructor is unable to attend the class.
CLASS PACKS – TERMS & CONDITIONS

Your class pack will commence from the purchase date.

All class packs are non-refundable and non-transferrable between clients.

Intro Offers (4 classes for $60 or 2 Hot Mat/Mat classes for $30) are limited to one purchase per client.

All class bookings must be made via our ‘Flow & Co. Pilates’ App.

Bookings can be made up to 60 days in advance.

MEMBERSHIP – TERMS & CONDITIONS

By purchasing a membership, you agree to weekly auto payments of the chosen membership amount for a minimum term of two weeks.

Your membership will commence from the date of purchase. Every week you will be charged on the same day as your activation.

Memberships will continue with scheduled auto payments on your selected date unless notified in writing.

Membership bookings can be made up to 60 days in advance.

All memberships purchased are non-refundable and non-transferrable between clients.

A dishonour fee of $10.00 will be charged to you by Stripe for any payments that are unable to be processed. Stripe will attempt again to process the payment amount 1 day after this period for 3 consecutive days. If the payment fails 3 times, all future bookings will be deleted automatically.


Membership Changes:

Any changes to lower a spend amount require a 14 day notice period prior to your next auto payment date.

Members wanting to increase their spend need to do so before your next scheduled payment, and will be committing to a further two weeks on this membership.

Suspending / Freezing Membership:

If for any reason you need to temporarily suspend your membership, Flow & Co. Pilates requires written notice via email 14 days prior to your next auto payment.

Suspensions/Freeze under a 14 day period will not be considered, unless under exceptional circumstances.

No more than 2 suspension/freeze periods will be granted over a 12 month period, from the start of your contract date.

Flow & Co. Pilates will suspend/freeze your membership for a maximum of 30 days. If you require a suspension/freeze for medical reasons for a longer period of time, please provide a medical certificate. Anything beyond 30 days is considered a membership cancellation.

The maximum total suspension/freeze period permitted on any membership is 2 months.

A minimum of 14 days prior to your next billing date is required to stop future payments. If you do not give us 14 days notice, the 14 days will still be charged.
Upfront Memberships Cancellation Policy

Upfront memberships are paid in full at the time of purchase and commence from the purchase date.

They are non-refundable, non-exchangeable, and non-transferable, with no credits or extensions for unused sessions.

All classes must be booked via the Flow & Co. Pilates App and are subject to standard studio policies.

STUDIO ETIQUETTE & SAFETY

At Flow & Co. Pilates we want everyone to get the most from each and every session, so we please ask for the following when coming along to your sessions:

  • Please arrive 5 minutes early to your scheduled class. This gives you a chance to get set up and ensures you do not interrupt a class that has already started. Late entries will not be allowed into the session (10 minute late cut off).
  • Make sure your phone is turned off or on silent.
  • It is highly recommended to wear grip socks in all reformer sessions. If you don’t have your own socks, you can purchase them at Flow & Co. for $14.95.
  • If you have any pre-existing injuries please advise our trainers prior to your session so we can accommodate accordingly.
  • After the session, please wipe down any equipment you have used. Flow & Co. will provide wipes or cloths.
  • You must be over the age of 16 to attend a class.
  • Children are not permitted in the studio. The only time they are permitted is during our baby friendly classes labelled as: ‘babies welcome to attend’, and they must remain in a pram, bouncer or mums arms only.

PREGNANT CLIENTS

If you are under 13 weeks pregnant and have GP clearance, you are welcome to attend any of our standard classes. Please ensure you notify the Instructor so they are aware and can modify if needed.

If you are over 13 weeks pregnant and would still like to attend, you must advise Flow & Co. Pilates and only attend the pre-natal classes labelled as: ‘pregnant Mums welcome to attend’.

PRIVACY POLICY

Flow & Co. Pilates is committed to protecting your privacy as an online visitor to our website. We use the information we collect about you to maximise the services that we provide to you. We respect the privacy and confidentiality of the information provided by you and adhere to the Australian Privacy Principles.

Information We Collect:

The type of information we collect is based on the information you give us including but not limited to your name, address, date of birth, email address and phone number or credit card information (Personal Details). Any credit card information is not retained or stored on our site. This is only captured and used to process any payment you make when purchasing or subscribing to our products and services.

We may also collect and store data relating to your image (if you have attended our class either online or at a studio), your fitness interests and preferences which may be captured from comments you make on any of our social media platforms.

We respect the privacy of our online visitors. We may collect information on or through this website that can personally identify you. For example, we collect personally identifiable information which you volunteer to us to respond to visitor questions and comments about us and our products and services, and to mail e-newsletters.

We may also collect additional information at other times, including but not limited to, when you provide feedback, change your content or email preferences, respond to a survey, or communicate with our customer support.

Information about you may also be provided to us from other sources, that is we may receive information from organisations we work closely with (third parties) e.g. business partners, authorised distributors, health and fitness clubs or other organisations that we work with to promote our brand, products and services.

If you connect with our business via social media platforms or features of our website which connect to your own online profiles or social media accounts, we may collect any information which you have permitted to be shared or made available via the settings of those individual social media accounts.

Use of Information:

We may use personal details collected from you to the extent permitted by applicable law for the purpose of providing you with direct marketing material, updates regarding our website and information in the form of a newsletter. This will only apply if you have registered or subscribed to receive our products and services.

We will also use your personal details to correspond with you regarding changes in our services and to inform you of account and policy changes which may happen from time to time.

If you wish to cease receiving any such information you may let us know either by email or by unsubscribing at any time and your request will be actioned immediately.

Your Personal Details are only supplied to a third party supplier when required by law, for goods or services which you have purchased, or to protect our copyright, trademarks and other legal rights.

We may use your personal details to allow you to participate in interactive features of our business, including data analysis, research and testing, statistical, editorial feedback and survey purposes. You may opt out at any time.

We will use all reasonable means to protect the confidentiality of your Personal Details while in our possession or control. We will not knowingly share any of your Personal Details with any third party other than our service providers who assist us in providing the services we provide to you. Some service providers may be overseas and may not be subject to Australian Privacy Laws.

Cookies and Pixels:

A cookie is a small file placed in your web browser that collects information about your web browsing behaviour. Use of cookies allows a website to tailor its configuration to your needs and preferences. Cookies do not access information stored on your computer or any personal information.

Our website uses cookies to analyse website traffic and help us provide a better website visitor experience. Cookies and pixels may also be used to serve relevant ads to website visitors through third party services such as Google Adwords and Facebook Adverts.


Disclosure of Your Information in Certain Circumstances

We may from time to time need to disclose certain information, which may include your Personal Details, to comply with a legal requirement such as a law, regulation, court order, subpoena, warrant, legal proceeding or law enforcement request.

We may use your Personal Details to protect the rights, property or safety of Flow & Co. Pilates, our customers or third parties.

If there is a change of control in our business (whether by merger, sale, transfer of assets or otherwise) customer information, which may include your Personal Details, could be disclosed to a potential purchaser under a confidentiality agreement.

Third Parties:

We do not and will not sell or deal in personal or customer information.

We will never disclose your personal details to a third party except the necessary information required by providers of products or services you have purchased, to protect the rights, property or safety of Flow & Co. Pilates, our customers or third parties, or if required by law.

We may use your information in a general sense without reference to your name to create marketing statistics, identify user demands and assist in meeting customer needs generally.

Retention of Personal Details

Any information and Personal Details we collect is retained only if we need it to support and operate our business or when (permitted by law) we have a purpose for using the information that requires us to retain it.

Subject to applicable legislative requirements, if you cease to be a subscriber or customer of our business we will only hold your personal information for a period of 18 months following the cancellation of your subscription/account. When we no longer require Personal Details, we (or any third party suppliers we use) will be required to delete the Personal Details.

Security of Your Personal Details

We maintain physical, technical and administrative safeguards in order to protect the personal details you provide to us via our website, studio or social media platforms.

We restrict access to your personal details to employees who need to know that information in order to provide our services.

We train our employees to understand the importance of confidentiality and privacy obligations.

Change of Details or Opt-Out

You may change your Personal Details at any time by advising us in writing via email.

You may opt-out at any time and request that we delete your personal details. Any customer who opts-out will have their records updated accordingly to remove their personal details from our systems, particularly in relation to marketing and promotional materials.

Changes to This Policy:

Subject to applicable legislation, we may update and change this Privacy Policy at any time. We will alert you to any changes and ensure a copy of the updated policy is made available either online or via post.

Any modifications or changes we make will be effective immediately unless otherwise stated.

If required by applicable laws, we will seek your consent for such changes and provide you with an opportunity to withdraw and cancel your subscription or membership with our business.
